1. Acceptance of Terms

Welcome to Classical Gems! These Terms and Conditions (“Terms,” “T&Cs”) govern your use of the Classical Gems website (www.classicalgems.in), all its subdomains, features, content, and applications offered by Classical Gems (collectively, the “Website”), as well as all services, courses, workshops, events, creative offerings, studio rentals, and other programs provided by Classical Gems both online and offline (collectively, the “Services”).

“Classical Gems,” “we,” “us,” or “our” refers to ASWATHI CLASSICAL GEMS, an institute based in Kozhikode, Kerala, India. “User,” “you,” or “your” refers to any person or entity accessing or using our Website or Services, including students, parents/guardians of students, clients, and website visitors.

By accessing our Website, registering for an account, enrolling in a course, booking any Service, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available privacy policy link), which is incorporated herein by reference.

If you are under the age of 18 or the age of legal majority in your jurisdiction, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

2. Eligibility

By using our Services, you represent and warrant that:

• You are at least 18 years old or, if you are under 18, you are using the Services with the consent and supervision of a parent or legal guardian who has agreed to these Terms.
• You are legally capable of entering into a binding contract with Classical Gems.
• All information you provide to us is true, accurate, current, and complete.
• You will maintain the accuracy of such information.
• Your use of the Services does not violate any applicable law or regulation in India or your jurisdiction.

Classical Gems reserves the right to refuse service, terminate accounts, or cancel orders in its sole discretion if we believe that you are in breach of these Terms.

3. Services Offered

Classical Gems offers a diverse range of Services dedicated to the promotion and learning of Indian classical arts, including but not limited to:

• Indian Classical Dance Courses: Online and offline classes in Bharatanatyam, Mohiniyattam, Kuchipudi, and other classical dance forms for various skill levels (beginner, intermediate, advanced) and age groups (kids and adults).
• Carnatic Music Courses: Online and offline instruction in Carnatic vocal music and instrumental music (e.g., violin, veena, mridangam) for all ages and levels.
• Visual Arts Courses: Online and offline classes and workshops in drawing (pencil, charcoal), painting (watercolor, acrylic, mural), clay modeling, and other art forms for kids and adults.
• Creative Offerings:
  • Arts Enrichment Programs: Tailored dance and music classes for schools, colleges, and other institutions at their campus.
  • Performances: Professional performances in Indian classical dance and music for events, festivals, and cultural programs. This includes Bharatanatyam, Mohiniyattam, Kuchipudi, Jugalbandi, and traditional Kerala art forms like Kathakali, Kalaripayattu, Ottamthullal, and Chakyar Koothu.
  • Dance Musical Productions: Choreography and production of Bharatanatyam-based dance musicals.
  • Theatre Training: Workshops and training in acting, voice modulation, and movement.
  • Arangetram Focused Training: Specialized guidance and preparation for Arangetram (debut solo performance).
  • Orientation Courses for Dance Professionals: Programs designed to assist aspiring dancers with career goals.
• Events & Workshops: Masterclasses, specialized workshops, art exhibitions, children’s art events, classical dance makeup workshops, and other cultural events.
• Studio Hire: Rental of our fully-equipped studio space for dance practices, workshops, rehearsals, photo/video shoots, and other creative projects.
• Online Free Trial Classes: Introductory online classes for selected dance forms, subject to availability and specific terms.

Specific details regarding course content, duration, schedules, fees, and prerequisites for each Service are provided on our Website or communicated at the time of inquiry or booking. Some Services may be subject to additional terms and conditions or separate agreements, which will be provided to you when you opt for such Services.

4. User Accounts (Student Portal)

• Registration: To access certain Services, such as our online student portal or specific courses, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Security: You are responsible for safeguarding your account password and any other credentials used to access your account. You agree not to disclose your password to any third party. You are solely responsible for any and all activities or actions that occur under your account, whether or not you have authorized such activities or actions.
• Unauthorized Use: You must notify Classical Gems immediately of any unauthorized use of your account or any other breach of security. Classical Gems will not be liable for any loss or damage arising from your failure to comply with these security obligations.
• One Account Per User: You may create only one account unless explicitly permitted by Classical Gems.
• Account Termination/Suspension: Classical Gems reserves the right to suspend or terminate your account and access to the Services at any time, without notice, for any reason, including but not limited to:
  • Breach of these Terms or the Privacy Policy.
  • Provision of false, inaccurate, or incomplete information.
  • Non-payment of fees.
  • Engaging in unlawful, fraudulent, or abusive activity.
  • Disruptive behavior that interferes with the learning environment or the rights of others.

5. Bookings, Payments, Fees, Refunds, and Cancellations

• Booking Process: You can book Services through our Website, by contacting us via email, phone, WhatsApp, or in person. Bookings are subject to availability and confirmation by Classical Gems.
• Fees and Payment:
  • All fees for Services are listed on our Website or will be communicated to you at the time of booking. Fees are quoted in Indian Rupees (INR) unless otherwise specified.
  • Payment for Services must be made in advance or as per the payment schedule agreed upon at the time of booking. We accept various payment methods as indicated on our Website or invoices.
  • You are responsible for all applicable taxes, including Goods and Services Tax (GST), as per Indian law, which will be added to the fees where applicable.
  • Classical Gems reserves the right to change its fees or billing methods at any time. We will provide you with reasonable notice of any such changes.
• Refund and Cancellation Policy:
  • Courses (Online/Offline):
    • Free Trial: If you are participating in a free trial, there are no fees, and thus no refunds.
    • Paid Courses:
      • Cancellations made at least 7 days before the course start date may be eligible for a full refund, less any administrative or transaction fees.
      • Cancellations made less than 1 day before the course start date or after the course has commenced are generally non-refundable.
      • No refunds will be issued for missed classes by the student. In exceptional circumstances (e.g., medical emergencies with proof), Classical Gems may, at its sole discretion, offer a credit for future classes or a partial refund.
      • If Classical Gems cancels a course, registered students will be offered a full refund or the option to transfer to another course of equivalent value.
  • Workshops & Events:
    • Fees for workshops and events are generally non-refundable unless otherwise specified for a particular event.
    • If you cancel your participation, you may be able to transfer your registration to another person, subject to Classical Gems’ approval and any applicable administrative fees.
    • If Classical Gems cancels a workshop or event, registered participants will receive a full refund.
  • Creative Offerings (Performances, Productions, etc.): Refund and cancellation terms for bespoke creative offerings will be detailed in the specific service agreement or contract for that engagement.
  • Studio Hire:
    • Cancellations made at least 48 hours before the booked time may receive a full refund.
    • Cancellations made less than 48 hours before the booked time may forfeit the booking fee.
    • Details will be provided at the time of booking.
  • Processing Refunds: Any approved refunds will be processed within 15-30 working days to the original mode of payment or as otherwise agreed.
• Non-Transferability: Unless explicitly stated, course enrollments and service bookings are non-transferable to other individuals.

6. Code of Conduct and User Obligations

You agree to use the Services in a manner that is lawful, respectful, and consistent with the educational and artistic environment of Classical Gems. You agree to:

• Respectful Behavior: Treat instructors, staff, and fellow users with courtesy and respect in all interactions, both online and offline. Harassment, bullying, discrimination, or any form of abusive language or behavior is strictly prohibited.
• Compliance: Adhere to all rules, guidelines, and instructions provided by Classical Gems instructors and staff regarding participation in classes, workshops, events, and use of our facilities or online platforms.
• Punctuality and Preparation: Be punctual for all classes and sessions. For online classes, ensure you have the necessary technical setup and a suitable environment free from distractions.
• Non-Disruption: Refrain from any behavior that disrupts the learning environment, interferes with the Services, or infringes upon the rights of others.
• Health and Safety (Physical Classes/Studio Use):
  • You are responsible for ensuring you are medically and physically fit to participate in physical activities such as dance.
  • You must inform Classical Gems of any pre-existing medical conditions, injuries, or limitations that may affect your participation.
  • You participate in physical activities at your own risk. Classical Gems is not liable for injuries sustained unless caused directly by our gross negligence.
• Prohibited Activities: You shall not:
  • Use the Services for any unlawful purpose or in violation of any local, state, national, or international law.
  • Record, photograph, reproduce, distribute, or publicly display any part of the classes, course materials, performances, or other proprietary content of Classical Gems without prior written permission.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware, or telecommunications equipment.
  • Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Attempt to gain unauthorized access to our Website, student portal, computer systems, or networks connected to our Services.

Violation of this Code of Conduct may result in immediate suspension or termination of your access to the Services without refund, and may also subject you to legal action.

7. Online Classes and Platform Usage

• Technical Requirements: You are responsible for ensuring you have the necessary equipment (computer, tablet, or smartphone), a stable internet connection, software (video conferencing applications like Zoom or Google Meet as specified by us), and a suitable, quiet environment to participate effectively in online classes.
• Platform Terms: Online classes may be conducted through third-party platforms. Your use of such platforms is also subject to their respective terms and conditions and privacy policies.
• No Guarantees: Classical Gems is not responsible for any technical issues, internet outages, or equipment failures on your end that may prevent you from accessing or participating in online classes. No refunds will be provided for classes missed due to such issues.
• Recording: Unauthorized recording of online classes is strictly prohibited. Classical Gems may record sessions for quality control, training, or providing access to registered students who missed a live session, subject to our Privacy Policy and instructor discretion.

8. Offline Classes and Studio Usage

• Studio Rules: All users of our physical studio premises must adhere to the studio rules and regulations, which will be displayed at the studio or communicated to you. This includes rules regarding footwear, food and beverages, and general conduct.
• Personal Belongings: Classical Gems is not responsible for any loss, theft, or damage to personal belongings brought to the studio. Please secure your valuables.
• Damage to Property: You will be held responsible for any damage caused to Classical Gems’ property or studio equipment due to your negligence or willful misconduct.
• Studio Hire Specifics: If you hire our studio, you agree to use the space only for the permitted activities agreed upon at the time of booking. You are responsible for leaving the studio in a clean and tidy condition. Additional terms regarding security deposits, cleaning fees, and liability for damages may apply and will be outlined in the studio rental agreement.

9.   Creative Offerings (Performances and Workshops)

• Separate Agreements: Bespoke creative offerings such as performances, dance musical productions, arts enrichment programs for institutions, and extensive workshops may be subject to a separate written agreement or contract detailing the scope of work, deliverables, fees, payment terms, cancellation policies, and intellectual property rights specific to that engagement. These Terms will apply to the extent they are not superseded by such specific agreements.
• Client Responsibilities: For services like performances or on-campus programs, the client may be responsible for providing suitable venues, technical support (e.g., sound, lighting), and fulfilling other logistical requirements as agreed.

10. Free Trials

Classical Gems may, from time to time, offer free trial classes for certain Services.

• Terms: The duration, scope, and availability of free trials are at the sole discretion of Classical Gems and will be specified at the time of the offer.
• Limitations: Free trials are typically limited to one per person or household for a specific service and may not be combined with other offers.
• No Obligation: Participation in a free trial does not obligate you to purchase any paid Services.
• Conversion: After the free trial period, access to the Service will typically require enrollment in a paid plan.

11. WhatsApp Communication

By initiating a chat with Classical Gems via our WhatsApp API button or by providing your WhatsApp number for communication, you consent to Classical Gems communicating with you via WhatsApp for purposes related to your inquiries, bookings, course information, scheduling, and customer support.

• We will not use WhatsApp for unsolicited marketing messages unless you have explicitly opted in to receive such communications.
• You should not share highly sensitive personal information (such as full financial details beyond what is necessary for payment confirmation) via WhatsApp unless specifically requested and secured.
• Your use of WhatsApp is also subject to WhatsApp’s own Terms of Service and Privacy Policy.

12. Disclaimers of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

CLASSICAL GEMS DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS; (C) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CLASSICAL GEMS OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

WHILE WE STRIVE TO PROVIDE HIGH-QUALITY INSTRUCTION, CLASSICAL GEMS MAKES NO GUARANTEES REGARDING THE LEVEL OF SKILL, PROFICIENCY, OR ARTISTIC DEVELOPMENT THAT A STUDENT MAY ACHIEVE. INDIVIDUAL PROGRESS DEPENDS ON VARIOUS FACTORS, INCLUDING PERSONAL EFFORT, PRACTICE, AND NATURAL APTITUDE.

13. Modifications to Terms and Services

• Modifications to Terms: Classical Gems reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 15-30 days’ notice prior to any new terms taking effect by posting a notice on our Website or by sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Website or Services after those revisions become effective, you agree to be bound by the revised terms.
• Modifications to Services: Classical Gems reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice at any time. This includes changes to course content, schedules, instructors, and fees. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services. For ongoing paid Services, we will endeavor to provide reasonable notice of significant changes.

14. No Waiver

The failure of Classical Gems to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Classical Gems.

15.  Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of Classical Gems. Classical Gems may assign its rights and obligations under these Terms without restriction or notice to you.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other specific agreements or policies referenced herein or entered into between you and Classical Gems in connection with specific Services (e.g., studio rental agreement, performance contract), constitute the entire agreement between you and Classical Gems concerning your use of the Website and Services, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website and Services.
